CCTV request for an individual

General information
Members of the public have a right to request footage of themselves only and this would be handled as a Subject Access Request. Under the Data Protection Act 2018 we cannot release footage of other individuals, third parties or images that would lead to the identification of others, as this would be classed as their personal data and is not suitable for release. 

If your request is in relation to a road traffic collision, we are therefore unable to accept a Subject Access Request as we would only be able to provide images of you and not of third parties. In this situation you must go through your insurance company or legal representative. If your request relates to a road traffic offence, such as a fail to stop, you must go to the Police.

In accordance with the Act, Tandridge District Council may refuse to provide footage to you if it may be likely to prejudice:
  • prevention and detection of crime; or 
  • apprehension and prosecution of offenders.
If no data is held in relation to your request, or the data falls into a category exempted from disclosure, you will be notified in writing of this. 

Fee
There is a charge of £120 which will cover the administrative costs of complying with your request. This will need to be paid before we carry out our search and is non-refundable.

The application form
If you wish to make a request for CCTV please complete all sections of this form and submit it together with two identification documents.

Timescale
We must normally respond to your request within one month unless the request is complex. If it is, we may extend the time for a response by a further two months and inform you in writing.  The time-frame for responding does not commence until the Council is satisfied with your identity and the fee has been paid.

Identification
You are required to provide two forms of identification one of which must be photographic evidence. This could be in the form of a current passport or driving licence. The second form of identification should confirm your address.  Whilst allowing us to identify you in any footage, this is also to enable us to fulfil our duty to ensure that information we hold is secure and it must be satisfied that you are entitled to have the requested information.

Failure to provide this proof of identity may delay your application.
